SUBLETTING

Q. Respected Mufti Sahib assalmu alaikum can I sublet a premises that I am renting to some one else @ a higher rental?

(There may be grammatical and spelling errors in the above question. Questions are published as received)

A. It is permissible to sublet property that you are renting for a higher rental on condition that:

a) The landlord has not prohibited subletting.

b) You have made improvements to the premises that increase its value (for example, you painted the premises or you tiled it, or added an aircon etc).

If you did not make any improvements to the premises, you cannot sublet it for more than the rental you are being charged.
