QADHA AFTER FAJR AND ASR

Question and Answer:

Q. Is it permissible to read Qadha Umri after Fajr and After Asr? I am confused because some people say you cannot read any Salaah after Fajr and Asr and some people say you can read Qadha. Please explain


A. It is Makrooh to perform Nafl Salaah after Fajr till sunrise and after Asr till sunset (Maghrib). This is based on the Hadith in which Rasulullah (Sallallahu Alaihi Wasallam) said:

لا صلاة بعد الصبح حتى ترتفع الشمس، ولا صلاة بعد العصر حتى تغيب الشمس

“There is no Salaah after Fajr till the sun rises and there is no Salaah after Asr till the sun sets” (Sahih al-Bukhari, Hadith #: 586, Narrated by Abu Sa’eed al-Khudri)

The Muhaddithoon (experts of Hadith) and Fuqahaa (Jurists) have stated that this refers to Salaah that is not Fardh. Therefore to pray Nafl or Sunnah Salaah after Fajr or after Asr is Makrooh. Since the Karahah (reprehensibility) is not applicable to Fardh Salaah, it will be permissible to perform Qadha Salaah after the Fardh of Fajr and Asr. (Umdatul Qari, Vol: 5, Pg: 81, Hashiyatut Tahtawi, Pg: 188)

(لا صلاة) ، كلمة: لا، لنفي الجنس أي: لا صلاة حاصلة بعد الصبح، أي: بعد صلاة الصبح، ويقال: هذا نفي بمعنى النهي، والتقدير: لا تصلوا. ثم قيل: إن النهي للتحريم، والأصح أنه للكراهة. وبالنظر إلى صورة نفي الجنس قال أبو طلحة: المراد بذلك كل صلاة، ولا يثبت ذلك عنه. وقال أصحابنا: ولا بأس أن يصلي في هذين الوقتين الفائتة، ويسجد للتلاوة، ويصلي على الجنازة.


However, with regards to performing Qadha Salaah after the Fardh of Asr, this will be permissible before the sun loses its glow. Once the sun becomes pale and looses its glow, it will not be permissible to perform Qadha as this is a Makrooh time.
